The Artwork
An original acrylic painting on cotton canvas, in the size and concept agreed with the Client, with a canvas depth of approximately 3.5 cm.
This is a one-of-a-kind original; no identical original will be produced.
Fee & Payment
The total commission fee is set and agreed upon by email between the Artist and the Client before work begins. It is paid in two installments:
- · 50% deposit upon signing — earned on signing to cover materials and reserved studio time. Work begins on receipt.
- · 50% balance upon notice of completion, before the piece is shipped.
Payment by bank transfer or Wise. All bank fees, intermediary charges, and currency conversion costs are the Client’s responsibility — the Artist should receive the full USD amount net of any deductions.
Timeline
The Artwork will be completed and ready for dispatch within up to 8 weeks from the date this Agreement is signed and the 50% deposit is received. The Client will receive updates at key stages. To keep on track, the Client is asked to respond to the approval request within a reasonable time — any delay in response extends the deadline accordingly. Delays beyond the Artist’s control (illness, force majeure, courier or materials disruptions) will be communicated and extend the timeline accordingly.
Creative Process
The Artist will share a compositional study once, and where relevant an indication of the color direction, for the Client’s approval. Once approved in writing (email is sufficient), the composition is locked; any changes requested after this point may be quoted separately and extend the timeline. Final aesthetic decisions — brushwork, color, surface, palette — rest with the Artist. The finished painting will be consistent with the approved study but is not a literal copy of it.
Shipping, Taxes & Customs
Shipping is not included in the commission fee and is quoted separately once the Client’s full shipping address has been provided. All shipments are fully insured. All delivery-related costs — shipping, customs duties, import taxes, VAT, and any local fees — are the Client’s responsibility. Original paintings generally ship under HS code 9701, duty-free in most countries; import VAT and local taxes may still apply. Risk of loss transfers to the Client upon delivery.
The Client is asked to inspect the Artwork within 72 hours of delivery and notify the Artist in writing, with photos, of any transit damage — claims made later cannot be filed with the insurer.
Copyright
Copyright remains with the Artist. The Client owns the physical Artwork and may share photos publicly with credit to the Artist, but may not reproduce, print, or use it commercially, nor use it to mint NFTs or train AI models. The Artist may use images of the Artwork for portfolio, exhibitions, and press.
Cancellation & Returns
If the Client cancels after signing, the deposit is not refunded, as it has been earned in materials and reserved studio time. If the Artist cannot complete the work due to circumstances beyond her control, she will refund the deposit on a fair pro-rata basis. If the Client does not respond or pay the balance within 30 days of notice of completion, the Artist may charge reasonable storage; after 90 days without response, the commission is considered abandoned and the Artist may retain the deposit and the Artwork. Once the Artwork is delivered, no returns or exchanges are accepted.
